In a brief submission through his Lawyer Murder suspect Joseph Kuria Irungu for the second time filed an application before the trial Judge pleading to be released on bond.
The applicant assured the court that he is not a flight risk, no past criminal record and he is not a gun lover contrary to the photos of him posing with a high powered machine gun in social media.
Under article 50 in the 2010 new Constitution of the Republic of Kenya the accused is presumed innocent until proven guilty.
The Murder suspect in one of his several prayers also reminded the Court that all offence under the law is bailable.
While responding to the applicant submission the State Prosecution through Catherine Mwaniki urged Justice James Wakiaga to deny the applicant bond.
The State strongly stressed that Joseph Kuria Irungu has no fixer board and he is a flight risk if granted bond by the trial Court.
Catherine opposed the accused being released on bond since he was a threat to the Family of the Victim and key witnesses.
The Family on their response through their lawyer associated with the submissions of the State and informed the Court that the applicant has not given the Court a Compelling reasons to warrant him bond.
Joseph Kuria Irungu and Jacqueline Wanjiru Maribe were charged with the murder of Monica Kimani a business lady.
Maribe who was a news anchor at Citizen TV was released on bond and has been attending court sessions.
The trial Judge Justice James Wakiaga will deliver a ruling on the review of bond application on June 18th 2019 at 9am.
