KENYAN LAW MAKERS CLAIM THEY ARE UNDER PAID

A bench extended orders barring Kenyan National Assembly Representatives from allocating to themselves monthly house allowance of 250,000 Kenya shillings until the matter before it is heard and determined.

In a petition filed before a Constitutional Court at Milimani Law Court Nairobi County Kenya, by Salary Renumeration Commission and Activist Okiya Omtata.

The petitioners alleged that Parliamentary Service Commission acted illegally to award members of Parliament housing allowances .

SRC through the Constitution of Kenya is the only body mandated to regulate State Officers payments.

While members of Parliament through their officer of the court Prof Tom Ojienda while submitting stressed that the Kenyan MPs are under paid.

The Prof further claimed that the Members of Parliament deserve Constituency and house allowance while travelling from their region to attend the sittings at the National Assembly.

Prof Ojienda gave an example of the house of commons in Britain and India where the Legislators are paid house and Constituency allowances.

In their lengthy submission before Justice Weldon Korir, Lady Justice Pauline Nyamweya and Justice John Mativo, the law makers alleged SRC want to finish them .

As the commission through Lawyer Wanyama seeks the Constitutional Court to restrain PSC from acting illegally and MPs be forced refund all the money they previously received as house allowances.

All the parties were given fair time to submit their applications.

The bech will deliver the land mark Judgment on 16th March 2020 at 3pm East Africa Time.
