KENYAN DETECTIVE JUMP OUT OF A SPEEDILY MOVING VEHICLE AFTER BEING THREATENED, TO BE SHOT AT A CLOSE RANGE BY A CITY BUSINESSMAN

A Kenyan Detective attached at Director of Criminal Investigation (DCI) risked his life by jumping out of a speedily moving vehicle.

The Officer was threatened by accused who is a licensed firearm holder, after they successfully arrested him for evading to pay tax amounting to over 173 million Kenya shillings.

In application filed and submitted before Nairobi’s Senior Principal Magistrate Peter Ooko at Milimani law Court.

The State prosecution in one of her several prayers humbly submitted before the trial court, urging the court to deny the accused bond and bail, since the accused displayed an attitude of being dangerous and violent by threatening the life of a serving Officer .

The trial Court remanded the accused at Nairobi Industrial Area Remand Prison pending a ruling on bond and bail application on Tuesday 15th October 2019 at noon East Africa Time .

The defence through Veteran Lawyer Gibson Kimani of Kioko Kilukumi Advocates and Company, requested the court to release the accused on bond in line with the Constitution of the Republic of Kenya.

Kimani further stressed that the bond is not a favour from the State to the accused but a Constitutional right and a requirement to make sure that, the accused attend the court proceedings.

The accused Hassan Ahmednur Baricha together with his Company Hanamal Construction Limited.

Were charged with five counts of fraud in relation to tax evasion , contrary to section 97 (c) as read with section 104 (3) of the Tax procedure act of 2015.

Hassan pleaded not guilty and also on behalf of his company.

Senior Principal Magistrate Peter Ooko directed the parties to appear for bond and bail ruling on Tuesday 15th October 2019 at Noon East Africa Time.

Hassan Ahmednur the Director of Hanamal Construction Limited, who appeared before the trial Court from his hospital bed after a warrant of arrest was issued on Friday 11th October 2019 by Milimani Lower Criminal Court Chief Magistrate Francis Andayi .

Threatened to shoot a Director of Criminal investigation (DCI) officer seconded to the Kenya Revenue Authority (KRA) during his arrest on the night of Tuesday 9th October 2019.

The ugly incident forced the disciplined officer to use his trained military skills by jumping out of a speedily moving vehicle to save his precious life.

Hassan Ahmednur together with his Company Hanamal is alleged to have evaded paying the Kenya Revenue Authority tax amounting to over 173 million Kenya shillings.
