Appearing before Anti Corruption Chief
Magistrate Douglas Ogoti at Milimani Law
Court Nairobi County Kenya, the Former
President of Law Society of Kenya temporarily
stopped his Prosecution after obtaining high
court orders.
Through certificate of urgency Eric Mutua filed
an application before a Constitutional Court at
Milimani seeking orders to stop the Director of
Criminal investigations from arresting him and
the Director of Public Prosecutions from
prosecuting the criminal case against him.
Where Eric Mutua is accused of stealing 533.8
Million shillings after the alleged sale of Malili
Ranch to Ministry of Information and
Communication to build the much advertised
ICT Konza City.
The stay of the proceedings at the lower
criminal Court was issued by Justice Weldin
Korir stopping further investigation, arrests and
possibly Prosecution until the matter is heard
and determined before the Constitutional Court.
The former Law Society of Kenya President is
allegedly accused of offering conveyancing
services but through his officers of the Court
denied involvements in the mega transaction.
The lawyer is being sought by Director of Public
Prosecutions to answer charges of theft for the
alleged sale and compensation of 5000 acres
Malili ranch.
On grounds of emerging new evidence brought
forward by the complainant through a recorded
statement.
It is alleged that the land at the center of
dispute was sold to the Government of Kenya in
the year 2009 June 25th and March 19th 2010
and he Mutua is alleged to have pocketed the
huge amount of money over half a billion Kenya
shillings.
