COURT REINSTATES KIAMBU MAGISTRATE WHO SAVED GOVERNOR WAITITU FROM ARREST BY EACC

Nairobi’s Labour Relations Court on Friday 30th August 2019 at 3.46 pm East Africa Time, ordered the Suspended Kiambu County Senior Magistrate Bryan Khaemba to immediately report back to work.

The Senior Principal Magistrate Bryan Khaemba who is alleged and Controversially issued an anticipatory bail of half a Million Kenya shillings to Kiambu Governor Ferdinand Waititu from being arrested by EACC is back at work.

Justice Byrum Ongaya Labour relations Court at Milimani Law Courts Nairobi County Kenya, faulted the Kenyan Chief Justice for suspending the Senior Magistrate without pay as unconstitutional.

Through Senior Lawyer and the aspiring President of Kenya Law Society (LSK) Nelson Havi, Senior Principal Magistrate Khaemba filed application before Labour Court challenging his suspension by his boss on grounds that the law was breached .

Justice Byrum Ongaya described the Kenyan Chief Justice his Boss, David Maraga’s actions of suspending the Kiambu Senior Principal Magistrate as illegal and a breach of the Kenyan law.

Khaemba was ordered by Justice Byrum Ongaya the Labour Relations Court, to report back to work for redeployment and assignment.

He also delivered an order directing that all Magistrate Khaemba’s dues be payed immediately.

The Kenyan Chief Justice David Maraga suspended Kiambu Senior Principal Magistrate Bryan Khaemba on 13th June 2019 after a public outcry and an alleged pressure from the public contrary to the law.

The suspension against Kiambu Senior Principal Magistrate Khaemba was illegal, uncalled for, unlawful and abuse of authority by the President of the Supreme Court of Kenya .
