Nairobi’s Senior Principal Magistrate Derrick
Kuto deferred the plea taking by Activist Barasa
Kundu Nyukuri on Tuesday 25th August at
Kibera Law Court.
The Court was informed by the suspect lawyer
that, Barasa fell sick on the eve of plea taking
and has been admitted in one of the City
medical institution.
A claim which was opposed by the State
Prosecution on grounds that no medical
records of admissions were presented before
the duty court to back up the sickness theory.
The Investigating officer Peter Orwa Director of
Criminal Investigation Nairobi Area met the
suspect earlier and confirmed that the
suspect health condition was stable and even
went ahead to prepare the charges.
Barasa Kundu is alleged to have attempted to
move a motion before Bungoma County
Assembly, to be debated by the County elected
members with a mission to impeach Governor
Wicliff Wamangati on grounds for
misappropriation of County funds and abuse of
office.
The motion mover was latter arrested by
Detective Peter Orwa at Nairobi Hotel on
allegation that he was unlawfully being in
possession of County Confidential documents
Where he was arraigned before the said court
through a miscellaneous application requesting
for more days to complete preliminary
investigations.
Barasa Kundu will be charged with stealing
contrary to section 268 (1)as red with 275 the
penal code and handling stolen goods contrary
to section 322 (2) of the penal cord, his co
accused was charged three weeks ago and
released on cash bail.
The State Prosecution will consolidate the two
files after plea taking by Barasa the second
accused.
