A NEW DAWN AT LAW SOCIETY OF KENYA

With a fearless slogan ‘A Brave New Bar’

elected Law Society of Kenya President Nelson

Havi is on a mission to restore the lost glory,

vibrant and fearless Law Society in the Country

with machinery to rival the leaderships of

James Orengo, Paul Muite, Rachel Omamo and

others in the long list.

The LSK President elect, upon his victory to the

Office, filed a petition through his officers of the

Court, seeking the Court to bar all passengers

flights from China in the wake of Coronavirus

pandemic.

Where his prayers were granted and the matter

is still pending before a Constitutional Court,

hearing and it’s determination still not yet, talk

of justice being intentionally delayed on flimsy

ground in Kenya .

Kenyans were very excited after the LSK

President elect Nelson Havi successfully

petitioned the Government preparedness on

Coronavirus and won the first round.

Taking over from the famous People’s defender

Okiya Omtata who has been shuttling along

the corridors of Justice petitioning the

Government and State institutions on several

public matters.

The New LSK President with a slogan a brave

new bar is out not only to enrich himself by

representing his clients on a fee, but to offer

free legal services through LSK for Kenyans

Citizens to benefit where their rights have been

Infringed and ignored.

And his second fight for the citizens of Kenya, is

where he filed a petition before the same

Constitutional Court seeking orders to bar

Police from infringing the rights of Kenyans in

the pretext of observing an alleged illegal

Curfew Order.

In his prayers the LSK President seeks the legal

fraternity to be declared essential services,

since majority of Kenyans are being arrested

everywhere, everyday and at

odd hours and the law allows them to be

represented by the advocates of their choice.

A petition which was filed by LSK on Monday

30th March 2020 at noon East Africa Time

through Judiciary introduced new system of

electronic filing failed to achieve its first goal,

after the Judge Korir declined to issue orders

stopping the National Curfew in it’s fourth day

and even dismissed the proposal by the

applicant to extend the Curfew orders from 7pm

to 10pm.

The Court directed the applicant/petitioner to

serve the

respondents before Thursday 02nd April 2020

where the application will be heard as a matter

of urgency by all the parties submitting their

application and responses.

And the issue where the head of State decline

to swear in the selected through interview Court

of Appeal Judges, the newly elected Law

Society of Kenya President Nelson Havi, will

soon file a petition seeking the Court to bar all

Officers of the Court from the Office of the

Country Attorney General from appearing before

Court until the Court of Appeal Judges are

sworn.

If that move will fail, the LSK President will

again order all Officers of the Court

Countrywide to boycott Court for unspecified

period until the Court of Appeal Judges will be

sworn by the Head of State.

The reason why the Judges employer JSC went

for a recruitment drive was to assist in the

backlogs of cases within the Country and speed

up Justice, since Justice delayed is Justice

denied.

As Lawyers Nationally called for the Country

Chief Justice Maraga to review his earlier

orders of shutting down the Court by reopening

the

Courts Countrywide, since other matters need

urgent hearing to avoid backlogs, where they

advise the Chief Justice to lay down frame work

and special arrangements for the hearings and

mentions of several pending cases to proceed.

Justice cannot be suspended and the alleged

lawless law enforcement units allowed to

arrests offenders, the vice is a clear ground for

bribery and corruption to breed and the Country

is on a mission to fight the monster called graft.

The rights of the accused under article 49 of the

new Constitution of Kenya is being violated and

the gains fought by Kenyans to usher in the new

Constitution being watered down.
