SINGING “BADO MAPAMBANO” LAND’S MAN IN HOT SOUP

It is alleged that the offence “singing bado mapambano while shouting” the act which was described by the State prosecution as creating disturbance landed a youthful man in big trouble.

Section 95 (1) (b) of the penal code, prohibits any Kenyan from shouting in a manner that creates disturbance within the public at any place within the Republic of Kenya .

Kepha Ojuka breached the law by singing and shouting on top of his voice “bado mapambano” an act which allegedly irritated the complainer Esther Kwamboka.

Ojuka is alleged to have committed the offence that’s attracts a minor penalty at Lower Hill (Upper Hill Nairobi County Kenya) on 11th of July the year 2019.

The accused who appeared before Nairobi’s Senior Magistrate Caroline Muthoni Nzibe was arrested on the day he allegedly committed the offence, released on a police bond of 3, 000. Kenya shillings.

And was ordered to appear on the 23rd of July 2019 to answer to the creating disturbance charges, where he pleaded not guilty and was freed on bond.

The State prosecution has lined up five key witnesses to testify against the accused in a weeks time.
