Nairobi’s Justice Luka Kimaru has suspended the deportation orders issued by Internal Security Cabinet Secretary Dr. Fred Matiangi directing four Chinese in police custody be deported back.
The four Chinese who runs a restaurant within Kilimani Nairobi County were arrested and arraigned before a lower criminal Court where an application requesting for more days for them to be detained was granted.
The four applicants were alleged for operating a business without valid documents.
Through their Officer of the Court Abdullahi Hakim the four applicant under certificate of urgency filed an application before High Court seeking orders to quash the deportation directives by the State Officer.
The application was received and stamped by Court registry on 17 February 2020, where in their prayers the applicant accused the Cabinet Secretary for disobeying the law and Court process.
The applicant through their Lawyer Abdullahi in their application stressed that the due process of the law must be followed before any orders on their deportation can be implemented.
Deng Hailang, Ou Qiang, Yu Ling and Chang Yueping are currently being held in police custody for investigations be completed under application which the State applied and was granted.
