LAND BUYERS CONNED AT ATHI RIVER

Any matter filed before court is not a subject of public debate, discussions or used as a tool of incitement until it is determined.

The dispute surrounding the ownership of the land at Athi River has taken a new twist with alleged buyers being incited by elected leaders to demonstrate against the owners.

As the matter is still pending in court, elected leaders within Nairobi County and Machakos County has resorted to use the social media in attacking and insulting the owners of the land.

In an going case at Machakos law Court over the disputed land, in case no 282 of 2012 Nirish Chandulal Shah against Kitangila limited.

In the loan agreement Kitangila dated 02nd November 2006.

The agreement between Nirish and Kitangila over a loan, which a suit file was filed on 30th July of 2012 after Kitangila breached the agreement.

In court documents filed at Machakos law Court, Kitangila offered L. R No. 10426/7 to Nirish as security for the repayment of the said loan.

And upon it’s failure to repay the loan Nirish filed the suit for which a degree was issued in his favor on 31st August 2012.

And an amended decree was issued later on 18th July 2013 to rectify an error pertaining the plot number in the original degree.

At same court Wisdom property Agencies Limited filed a suit against Nirish Chandulal Shah and others on 17th July of November 2014.

In case no. 169 of 2014 the plaintiff alleged that Kitangila limited sold the same property to it in 2007.

The allegations has never been proved through documents to date.

The plaintiff has never produced any legal documents to support his allegations of buying the property from kitangila in 2007.

No materials has never been produced before Court to support the alleged transactions.

The title to the property was obtained by Nirish Shah for valuable consideration prior to any other parties.

In another suit filed in Nairobi by Kitangila limited where Nirish was enjoined as defendant on 21st August 2013.

And enjoinment set aside on 17th May of 2017

In case 2316 of 2007 and 162 of 2015 Kitangila limited against Forward Agencies limited and another.

Where the applicant Kitangila is seeking an injunction to stop the dealings in L. R No. 10426/24 and 10426/27. The suit was filed on 13th July 2013, the suit has was later withdrawn.

The applicant going against the court procedure has deployed new methods of discussing the ongoing matter in public and social networks.
