KIAMBU DEPUTY GOVERNOR OBSESSED WITH POWER AND MISLED HIMSELF IN TAKING OVER

The hot debate Countrywide whether Kiambu Deputy Governor James Nyoro acted legally in declaring himself as the County boss, is creating new developments within the legal minds.

Deputy Governor can only assume the position of County Chief when the Governor resigns, impeached and certified by the Senate, critically ill or dead.

There is no provision of suspending the Governor, being barred from going to the County office is physical, it is like being barred from going to any building.

Section 32 (4) of the County Government Act, (4) when acting in office as contemplated in Article 179 (5) of the Constitution.

The Deputy Governor shall not exercise any powers of the Governor, to nominate, appoint or dismiss, that are assigned to the Governor under the Constitution.

Deputy Governor James Nyoro is practically in charge of the Governor building and not the functions of the Governor, Waititu is still the elected Governor of Kiambu County legally.

The Deputy Governor assuming the roles of the Governor must be sworn in and be gazetted, question is who can gazette?

If Kiambu Governor Ferdinand Waititu is convicted for twelve months, the Deputy takes over but if convicted for eleven months he is still the Governor while serving as a convict.

Deputy Governor Nyoro purporting to take over the functions of his boss and convening a cabinet meeting is illegal, being obsessed and against the County laws and the voters.

Public servants apply for jobs and get appointed their retirement age is 60, while the Governor is Mandated by the people through the ballot for five years with an extension of another five years.

In Kenya it is only 48 people who can sign development funds, contracts, appoint and sack Government officials and that is The President and 47 elected County Governors, even the Deputy President cannot appoint, sack or sign contracts.

Lady Justice Mumbi Ngugi ruling only ordered the Governor who is allegedly facing charges before Anti Corruption Court to step a side.

Kenyan Constitution states that any accused or suspect is innocent until proven guilty.
