Section 8. Leadership and Integrity act, State Officers shall not use the office to unlawfully or wrongfully enrich himself or herself.

The Speaker Kenya National Assembly intentionally and unlawfully conspired with his colleagues Members of Parliament to enrich themselves.

Speaker Justin Muturi by virtue of being the Chairman of Parliamentary Service Commission as stated in the petition filed before a Constitutional Court, on 03rd May 2019 Justin Muturi defended the decision of PSC to illegally and unlawfully award MPs 250,000 ksh as house allowance.

The Speaker is also on record in the Petition before High Court, justifying the illegal decision by saying that the Members of Parliament needed a house in Nairobi to live in while attending sessions in Parliament.

As a law maker the Speaker’s actions were illegal, unjustified and unconstitutional knowing very well as the Speaker of the National Assembly of Kenya and Chairman of PSC, that it is only the Salary and Remuneration Commission (SRC) that has the powers to determine who is entitled to certain allowance, and is exclusively, singularly vested by the Constitution of Kenya.

PSC illegal and unlawful actions begs the question of how the committee settled on ksh. 250,000 house allowance and by who’s order, the DCI have a big task since a criminal offence or economic crime was intentionally committed by the honorable elected Members subjecting the Tax payers into unnecessary poverty.

Through a respectable veteran Lawyer Peter Wanyama who’s actions rescued Kenyans by aggressively obtaining stay orders, on behalf of his client SRC in a bid to salvage the illegally acquired public funds totaling to 1.194 billion after the PSC backdated the illegal house allowance to MPs from October 2018.

The respectable advocate of the High Court obtained the orders on the same day he filed the petition on Friday 31st May 2019 as a matter of public interest and under certificate of urgency.

Kenyans breathed a sign of relief upon hearing that respectable and veteran Lawyer Peter Wanyama successfully convinced Justice John Mativo in charge of the the Constitutional Court and obtained stay stopping PSC from awarding themselves 250,000 ksh unlawfully until the matter is heard and determined.

Lawyer Peter Wanyama on behalf of his client SRC is also seeking Conservatory orders, to direct the clerk of both the National Assembly the Senate to speedily deduct the illegally acquired public funds and returned to the National Treasury.

It is on record the National Treasury upon receiving the Memorandum from PSC requesting for allocation of house allowance, warned the PSC to seek more advise and directions from SRC the Institution mandated by the Constitution to review salaries and any allowances.

But PSC acted against the law by breaching section 7 of the leadership and Integrity law, which states that State Officers shall respects and abide by the Constitution and the law.

The State Officer is a position of public trust the authority and responsibility, Members of Parliament including the Public Services Committee acted illegally and an responsible.

Unable to accept the mistake and do the necessary by apologising to the entire Kenyans by refunding the illegally acquired public funds, through guiltiness the Members of Parliament deployed gangster tactics and characters by denying SRC 300 Millions Kenya shillings meant for the operations within the Independent Institution.

The actions of the National Assembly has been condemned by a section of elected legislators Countrywide, who warned their colleagues to stay away from unnecessary blackmail and witch hunt.

Several legislators Nationally advised their colleagues to stop hitting back at SRC by technically dismantling the operations through funds denial and budget cut.

In mid January May 2019 SRC learnt of a decision of PSC made on 24th April 2019 to illegally pay Members of Parliament house allowance of 250,000 Kenya shillings each backdating to October 2018.

In the 2010 new Constitution of the Republic of Kenya SRC is mandated to review matters relating to the salaries and remuneration of public officers, also to advise County Governments the harmonisation equity and fairness of remuneration.

In the Bible book of Old Testament Ecclesiastes, “A Country is in trouble when it’s leader is a youth and all the leaders feast all night long, but a Country is fortunate with a king who makes his own decisions with leaders who eat at the proper time and control themselves without getting drunk”.
