GOVERNOR SONKO APPLICATION SEEKING BAIL DISMISSED

Nairobi County Kenya Governor Mike Sonko moved to the High Court seeking Anticipatory bail, where the Court dismissed his application on grounds that his rights has not been violated neither the respondent has not proved any form of violation.

Sonko faces eight counts of conspiracy to commit an offence of corruption, failure to comply with procurement laws, conflict of interest, abuse of office, unlawful acquisition of public property, deceiving, money laundering and acquisition of proceeds of crime.

Through his team of Lawyers led by Cecil Guyana Miller, Sonko seeks the Court to grant him bail to enable him appear before Anti Corruption with dignity to answer charges level against him.

The Governor who is alleged was arrested along Voi Taita Taveta County, in a commando style want the DCI to produce him before Court on Friday 06th December 2019 to answer to the alleged charges which the State has accused him of committing.

In his application filed before Justice John Onyiego the respondent Mike Mbuvi Sonko, alleged the State violated sections 4 of the Office of the public prosecution act, number 2 of 2013.

Appearing before Justice John Onyiego at Milimani law Court Nairobi County Kenya, the State prosecution raised an objection that the respondent has not served the State with it’s application.

Under certificate of urgency through Senior Counsel Cecil Miller the respondent alleged that section 21 of the Ethics and Anti Corruption Commission act number 22 of 2011 was breached.

In ex party application which was filed on Friday 06th December 2019 early morning after the State directed the immediate arrest of the respondent and be arraigned in Court, the Governor humbly urged the court to grant his prayers

The petitioner Mike Mbuvi Sonko served seven respondents the Ethics and Anti Corruption Commission, the Director of Public Prosecution, the Director of Criminal Investigations, the Attorney General, the Inspector General, the National Police service, IPOA and Abdi Mohamud the investigating Officer.

In his application Sonko is much disturbed why police are holding him and yet the State prosecution while directing for his arrest in a live broadcast and on record revealed to the nation that his office has surfficinet evidence to charge the Governor.

And following the press release by the Director of Public Prosecution, the respondent wants he be produced in Court or be given Anticipatory bail to appear in court on Monday 09th to take plea.

Sonko was arrested along Mombasa Road while heading for an official duty in Mombasa, the Governor will be be charged along side 21 other suspects who are yet to be arrested.

The officers from Nairobi County Government who facilitated, benefited from irregular procurement and payments amounting to 357,390,299 million Kenya shillings are Kioko Mike Sonko Mbuvi Gidion the Governor of Nairobi, Peter Mbugua Kariuki County Secretary, Patrick Mwanga Tender opening team, Edwin Kariuki Murimi Tender opening team, Lawrence Mwangi Mukuru Tender team, Preston mwandiki Miriti Tender team, Wambua Ndaka and Andrew Nyasiego both Senior Clerical Officers.

Private persons and business entities who benefitted from funds irregularly acquired from Nairobi County Government are Anthony Mwaura Nganga, Rose Njeri Nganga, Hardi Enterprise Limited, Toddy civil Engineering Limited, Arbab Auto Limited, ROG security limited, High Energy Petroleum limited and Antony Otieno Ombok.

Persons and Company’s that delivered various services to the County of Nairobi are Web tribe limited, Danson Muchemi Njunji, Robert Murithi Muna, Zablon Onyango Ochomo and Fredrick Odhiambo aka Fred Oyugi.
