Appearing before Nairobi’s Senior Magistrate
Bernard Ochoi at Milimani Law Court, where
there plea taking was deferred to 18th March
2020 and the six suspects freed on a bond of
50,000.
James Ndungu Githinji, Josiah Augo Otimo,
Geoffrey Ochieng Okello, Kennedy Ochieng
Asewe and Shadrack Ouma Ogonji faces
charges of creating disturbance in manner
likely to cause breach of peace.
The second, third and fourth suspects were
arrested for jumping bail after appearing in
another matter where they were charged with
the similar charge.
While the fifth suspect Ouma Ogonji
disappeared like thin air and switched off his
phone making it difficult for his lawyer to
inform him as the rest of the suspects were
freed on a bond of 50,000
It is alleged on 16th October 2019 at kihingo
Village Waridi Gardens in Kitusuru Estate within
Nairobi County jointly with others not before the
Court created disturbance in a manner likely to
cause breach of peace by forcefully breaking
the doors of a server room and chasing away
Wells Fargo security guards who were manning
the said facility.
The second, third, fourth and the fifth accused
were jointly charged with second count of
malicious damage to property of the same
facility.
The Officers of the Court representing the
complainant Prof George Wajakoyah and
Duncan Okatch in their brief submission urged
the court to deny the suspects bond until plea
is taken since the suspects were a flight risks
and demonstrated before court by jumping bail.
