The County Government of Nairobi will not be represented in the upcoming conferences organised by UN in United Arabs Emirates scheduled to begin on 08th to 13th of February 2020.
Nairobi’s Anti Corruption Chief Magistrate Douglas Ogoti dismissed Mike Sonko application requesting for the release of his two passports and other traveling materials to attend the session.
The application was dismissed on grounds that the applicant the Governor through his Officers of the Court George Kithi and Cecil Miller failed to prove before Court the source of the alleged invitation.
It was further established that the said invitation letter was first send to Ministry of Foreign Affairs on mid September the year 2019.
And while submitting the Governor presented an invitation letter which stated that it was send on 03rd February 2020 and was directed to the ministry of Foreign Affairs.
The applicant also failed to provide the endorsement letter from the Ministry of Foreign affairs since the invitation letter head was specifically addressed to the ministry of foreign affairs.
Anti Corruption Chief Magistrate Ogoti while delivering a brief ruling, stressed that the trial court cannot go against it’s own orders since by granting the application since the applicant failed to address the court on how he acquired the letter and one of the bond conditions was very clear, that the Governor should stay away from the County Office or seek Court permission and be escorted to the County office by Director of Criminal investigations Officers to collect any material of necessity.
On their response during the submission the State Prosecution urged the Court to dismiss the application in totality since the letter needed verification on it’s authenticity and the source.
They also complained that the time the defence served them with the application was very squeezed leaving the State office with no time to go through the application and respond in filing or orally accordingly .
State Prosecution informed the court that they were ambushed with the application and other materials like the traveling itinerary were served to them before court contrary to normal procedure.
It was also established before court that the applicant Governor Mike Sonko despite claiming that the UN organisers of the event invited him, the Governor paid for his own expenses, traveling and booked his own accommodation.
